This page is used to inform users of the Proxi app regarding Emux Technologies's policies about the collection, use and disclosure of personal information.

If you choose to use the Proxi app, then you agree to the collection and use of information in relation to this policy. The personal information that Emux Technologies collects is used for providing and improving the Proxi app and third-party services, as well as informing other consumers about current events. Emux Technologies will not use or share your information with anyone except as described in this policy.

Scope of policy

For the purpose of this document, the Data Protection Legislation shall mean any data protection legislation from time to time in force in the UK including the Data Protection Act 1998 or 2018 or any successor legislation and (for so long as and to the extent that the law of the European Union has legal effect in the UK) the General Data Protection Regulation ((EU) 2016/679) and any other directly applicable European Union regulation relating to privacy.

This policy, together with our Terms of Service as set out at https://emux.app/terms and any additional terms of use incorporated by reference into the Terms of Service applies to your use of Proxi.

This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us.

For the purpose of the Data Protection Legislation, the data controller is Emux Technologies Limited; our nominated representative for the purpose of the Data Protection Legislation is Felix Arkle.

Information we may collect about you

We may collect and process the following data about you:

  1. Information you give us (Submitted Information)
    You may give us information about you by filling in forms on Proxi or by corresponding with us by email or otherwise. This includes information you provide when you register with Proxi. The information you give us may include your name, username, password, profile photo, and any other information you provide.
  2. Information we collect about you
    With regard to each of your visits to Proxi, we may automatically collect the following information about you:
    • Technical information, including the type of mobile device you use, mobile network information, your mobile operating system, the type of mobile browser you use (Device Information)
    • Details of your use of Proxi (Log Information)
    • Location information ─ We use GPS technology to determine your current location. Some of our location-enabled services require your personal data for the feature to work. If you wish to use the particular feature, you will be asked to consent to your data being used for this purpose. You can enable or disable location services when you use our service at any time through your mobile device settings (Location Information)
    • Statistical data ─ Proxi may collect information about user demographics through Google Analytics Demographics and Interest Reporting. This information will only be used for internal reporting and not shared with third parties
    • Activity data ─ Proxi is designed to track your location and activity. We may collect your activity data (for example location and distance) when you employ features in Proxi that are designed to capture your activity data
    • Contact information ─ You may have the option of providing contact information to us in order to get help from us. We will not collect this information unless you specifically elect to share this information with us
    • Data collected from Software Development Kits (SDK) ─ Proxi uses SDKs to distinguish you from other users. This helps us collect information about how you are using Proxi so we can ensure we are providing you with a good experience when using Proxi and allows us to improve Proxi in future. By downloading Proxi, you are agreeing to our use of SDKs

Uses made of the information

We use information held about you in the following ways:

  1. Information you give to us
    We may use this information:
    • to carry out our obligations arising from any contracts entered into between you and us and to provide you with the information, products and services that you request from us;
    • to notify you about changes to Proxi; and
    • to ensure that content from Proxi is presented in the most effective manner for you and for your device
  2. Information we collect about you
    We may use this information:
    • to administer Proxi and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;
    • to improve Proxi to ensure that content is presented in the most effective manner for you and for your device;
    • to allow you to participate in interactive features of Proxi, when you choose to do so;
    • as part of our efforts to keep Proxi safe and secure;
    • for research purposes carried out internally or by trusted third parties

Disclosure of information

We may share your information with selected third parties including but not limited to:

  1. Business partners, suppliers and subcontractors for the performance of any contract We enter into with you.
  2. Third parties with which we collaborate to advise and support them in the delivery of their public health function, but only in an anonymised manner.
  3. Analytics and search engine providers that assist us in the improvement and optimisation of Proxi.

We may disclose your personal information to third parties:

  1. If Emux Technologies Limited and/or Proxi is transferred to a third party organisation, in which case personal data held by it about its customers will be one of the transferred assets.
  2. If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our Terms of Service (https://emux.app/terms) and other agreements; or to protect the rights, property, or safety of Emux Technologies Limited, our customers, or others.

Where we store your personal information

All information you provide to us is stored on secure servers held in both the European Economic Area (EEA) and GDPR compliant international data processors only. Where international data processors are used, all appropriate technical and legal safeguards will be put in place to ensure that you are afforded the same level of protection as within the EEA.

Where we have given you (or where you have chosen) a password which enables you to access certain parts of Proxi, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to Proxi; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Your rights

You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data. Proxi may, from time to time, contain links to and from the websites of our partner networks and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Access to information

The Data Protection Legislation gives you the right to access information held about you. Your right of access can be exercised in accordance with the Data Protection Legislation.
